Auto accidents can cause serious and sometimes life-changing injuries, such as spinal cord injuries, broken bones, deep cuts, lacerations, traumatic brain injuries, and internal organ damage. Following a catastrophic injury, victims can face steep medical costs, a loss of income, emotional distress, and long-term pain and discomfort. These hardships are difficult to live with, fortunately, the State of New Jersey offers legal remedies to certain injured victims of car accidents.

The State of New Jersey is considered a “no-fault” state when it comes to obtaining compensation after a car accident. This means that when a person is injured in a traffic accident, he or she does not need to demonstrate in a court of law who caused the accident in order to obtain monetary compensation for the injuries and damages sustained. Instead, injured victims can seek compensation through their own auto insurance coverages. Through the Personal Insurance Protection (PIP) program, injured people can obtain compensation to cover medical costs and loss of income. Unfortunately, a vast majority of auto accidents in New Jersey result in injuries and damages so great that PIP coverage alone does not cover.

When a person is seriously injured in a car accident caused as a result of another’s reckless or negligent actions, additional compensation can be obtained by pursuing a claim against the at-fault party. Filing a personal injury claim against the at-fault party, however, can be a challenge. As a result of aggressive insurers, obtaining fair compensation after the accident can be difficult to attain. Still, pursuing compensation is necessary when the serious injuries have led to mounting medical expenses, a loss of employment, and other economic hardships.

When an auto accident happens, it is important to take immediate action before important evidence is destroyed. Immediately after an accident and when possible, victims should take pictures of the accident scene, including pictures of property damage and injuries. When available, obtaining surveillance video of the scene is also highly recommended.

Aside from photographs and video, accident victims should also seek to obtain eyewitness statements and their contact information. Witness statements can strengthen a car accident lawsuit in more ways than one. For one, people who witnessed the accident are able to provide insight into how the accident occurred. When the witness statement aligns with that of the victim’s statement, this can prove that in fact, the other driver was responsible for causing the accident. Also, a witness statement will help support a he-said she-said case, ultimately aiding in helping the victim obtain monetary compensation for his or her damages.

Police reports are also valuable to an auto accident claim. Like witness statements, police reports can help protect a victim’s legal rights and strengthen the claim against the negligent driver. For this reason, it is important that auto accident victims contact authorities right away. Aside from an account of the events that followed the accident, the report will also obtain other essential information, such as the contact information of the drivers involved, the insurance information of the drivers, and witness statements.

Following a car accident, it is imperative that victims seek immediate medical attention, even if the injuries are seemingly minor. Unfortunately, there are many cases where a person fails to recognize the extent of harm sustained in an accident. By seeking immediate medical attention, the victim will ensure his or her injuries are taken care of. Further, a medical assessment and record will also help strengthen the case against the negligent driver. It is important that injured victims continue regular doctor visits and maintain their treatment since a failure to do so may result in being blamed for the extent of injuries.

Sadly, there are many accidents that prevent victims from collecting their own evidence. For instance, catastrophic injuries may disable a victim and require him or her to be rushed to the hospital. When the accident resulted in serious or fatal injuries, it is important that accident victims or their families seek the legal support of a well-versed auto accident attorney who has experience in these types of cases.

Auto accident cases in New Jersey are oftentimes difficult to pursue. Still, it is necessary for victims to seek compensation for their injuries and losses when the accident was caused as a result of another’s negligence. If you or someone you love was recently hurt in a car accident in New Jersey, you should know that there may be an opportunity for legal recourse against the party that caused the accident.
