Auto accidents can happen to anyone, including the safest and most vigilant of drivers. The unfortunate reality is that most people get in traffic accidents as a result of the abundance of dangerous and reckless drivers on the road.

Whenever a reckless driver causes an accident and the accident leads to an injury or the death of a loved one, it may be possible to obtain monetary compensation from the reckless driver.

Proving a case after a car accident is not a quick and simple task, but for those who are seriously injured, filing a personal injury claim may prove to be highly beneficial.

Proving a car accident case will involve various aspects of personal injury law. In order to achieve a car, it is necessary to demonstrate that the at-fault party was negligent at the time of the accident and that this negligence led to the accident. It is also necessary to prove that the at-fault person owed the victim a duty of care and that this duty of care was breached through specific, negligent conduct. Finally, the injured party will need to prove that his or her damages and injuries were sustained as a consequence of the reckless accident.

There are certain aspects of a personal injury claim that are easy to prove, but there are others that can prove to be an uphill battle. For instance, proving that the accused party owed the injured person a duty of care can be relatively simple, however, proving that the accused party’s negligence caused the victim’s damages can be difficult to prove. In order to prove this, it is first necessary to show that the victim’s damages exist.

Proof that the auto accident resulted in the victim’s damages is generally made through the use of expert testimony, such as that of surgeons, chiropractors, doctors, and other medical professionals.

It is worth noting that in every successful personal injury claim, the victim’s own fault will be considered. Based on the State of New Jersey’s modified comparative fault theory, a person who is injured in a car accident can be barred from seeking compensation if he or she has been found to be more than 50 percent responsible for causing the accident. When the injured person is found to be less than 50 percent at fault for the accident, the victim will be entitled to receive monetary damages. Instead of recovering the full damages award, however, the award will be reduced based on the percentage the injured person was found to be at fault.
